LampPost Copyright Complaints

LampPost Social Inc. respects intellectual property rights and expects hosts and other users to do the same. This page explains how to notify us of alleged copyright infringement on our Services under the Copyright Act (Canada).

Canada uses a notice process, not the U.S. Digital Millennium Copyright Act. For content we host, a notice that meets the requirements below lets us find the material and decide whether to remove it. Where the Copyright Act requires an intermediary to forward a notice, we will forward a notice that meets sections 41.25 and 41.26. A notice must not include a settlement offer or a demand for payment or for personal information.

This process applies to content on LampPost, including host promotional videos, photos, captions, and related User Content. Our broader rules for User Content appear in the Terms & Conditions.

Send a written notice to jared@lamppostsocial.com with the subject line "Copyright Complaint". Include:

• Your name and mailing address, and any other details that let us reach you
• The work you claim has been infringed, and your interest or right in that copyright
• The URL or other location on LampPost where the material appears, and the date and time of the claimed infringement
• A description of the infringement you claim
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law, and that the information in your notice is accurate
• Your physical or electronic signature

Do not include an offer to settle, or a request for payment or for personal information, including by a link. A notice that contains those things does not meet the Copyright Act's notice rules.

Incomplete notices may delay our ability to respond. We may share your notice with the uploader so they can respond or remove the content.

Upon receiving a valid notice, we may:

• Remove or disable access to the allegedly infringing material
• Notify the uploader of the complaint
• Where appropriate, terminate accounts of users who repeatedly infringe copyright

Soft-hide tools (for example, user reports on host videos) are separate from this copyright process and may remove content from public discovery pending review.

If your content was removed and you believe the removal was a mistake or misidentification, you may email a counter-notice to jared@lamppostsocial.com including your contact details, identification of the removed material and its prior location, a statement that you have a good-faith belief the material was removed or disabled because of a mistake or misidentification, and your signature. Notices and disputes are handled under the laws of British Columbia and the Copyright Act (Canada), subject to the Quebec consumer terms in our Terms & Conditions.

We may forward the counter-notice to the complaining party. If they do not notify us that they have filed an action seeking a court order, we may restore the material in our discretion and in accordance with applicable law.
